Cable Agency Report

April 19 - May 17, 2004

Thank you for this opportunity to highlight some of the things that the Cable Communications Agency has been involved with during the past month.

FRANCHISE FEE AUDITS

With the respect to our franchise fee audit with Bright House Networks, the City received yet another of what the City's auditor would categorize as a non-response from Bright House for our audit with them that is two years old.  Officer of Corporation Counsel is sending Bright House a letter and giving them a deadline to comply with data requests.  Progress continues to be made regarding Comcast's audit for years 2002-2003.

BRIGHT HOUSE'S NON-COMPLIANCE

You should have in your Board packets the latest response from Bright House's counsel regarding our request to explain their non-compliance.  Their counsel says that he reiterates the explanations of his client's telephone statistics and practices from the explanations dated in his March 18, 2004 letter to the City.  That letter represented that Bright House "does not intentionally manipulate the data to report compliance with customer service standards," which is contrary to what he told to Lori Kuhn, Bob Borgmann and myself when he met with bright House on October 21 of last year.

FIRST MILE

City's counsel and our office met with counsel from First Mile.  We made what I would categorize as marked progress.  After their counsel meets with client, we should know more in moving forward on this matter.

COMCAST INET

Comcast continues to report progress regarding the township fire department INET.  Mike Delph may be able to provide the Board with some details.  Once the INET has been utilized for a period of time, we would like to invite Chief Joe Anderson, President over township fire departments, on hand to offer his observations.

IACT MEETING

Our office met on the invitation of the Indiana Association of Cities and Towns to brief Bluffton Mayor Ted Ellis on a panel he was on at the NCTA (National Cable & Telecommunications Association) conference.  Mayor Ellis is the Telecommunications Chair for the National League of Cities.

MEDIATING CABLE COMPLAINTS

The Cable Communications Agency has been serving as a consumer advocate to Indianapolis and Marion County cable subscribers in assisting them in mediating cable complaints on their behalf.
