Unsafe Building Hearings are conducted pursuant to the Indiana Unsafe Building Law (Ind. Code 36-7-9) and Chapter 537 of the Revised Code of the Consolidated City of Indianapolis and Marion County by the Department of Business and Neighborhood Services. The Indiana Unsafe Building Law provides the City of Indianapolis the authority to issue orders requiring the repair or demolition of an unsafe building. Orders will specify both the nature of the work that must be completed to achieve compliance under the law and the timeframe in which the property owner has to make the repairs before a hearing is conducted by the Hearing Authority. The person to whom an order is issued, any person with a substantial property interest in the property, and any other person with an interest in the proceedings are entitled to appear at the hearing, with or without legal counsel, to present evidence, cross-examine opposing witnesses, and present arguments. At the hearing, the Hearing Authority may affirm, modify, or rescind the order. If the Hearing Authority affirms the order and finds there has been a willful failure to comply with the order, a civil penalty in an amount not to exceed $5,000 may be imposed. If the person to whom the order was issued fails to appear, the matter will be determined in his/her absence and a civil penalty may be imposed.

Biweekly hearings are held on Tuesdays at the Department of Business and Neighborhood Services. Morning hearings begin at 9:00 AM, with sign-in beginning at 8:00 AM. Afternoon hearings begin at 1:00 PM, with sign-in beginning at 12:00 PM.
