City of Indianapolis vs. Windy Johnston


INDIANAPOLIS – On March 11, 2004, a search warrant was served at the home of Windy Johnston, 23 N. Euclid, where 104 cats were removed from the property due to improper care and treatment.

Yesterday, the defendant, Windy Johnston plead guilty in a Marion County Superior Court to violating sections 531-403, general requirements for care and treatment; 836-2, operating a kennel without a license; 531-301, no current rabies vaccination; and 531-202, no permanent identification.

In addition, the defendant agreed to:

  • Pay a civil penalty in the amount of $1000;
  • Be permanently enjoined from operating a kennel without a license;
  • Remove her website advertising her kennel;
  • Be permanently enjoined from having the custody, care or control of not more than two (2) cats in the City of Indianapolis/Marion County; and
  • Surrender the 104 cats to Indianapolis Animal Care & Control.

86% of the cats seized from this property will be fostered and adopted through the national Cat Fanciers Association.  The president of this organization, from Arizona, is at Indianapolis Animal Care & Control spearheading and coordinating the effort.  The remaining cats will be transferred to a local shelter for adoption.

All adopters of the cats from 23 N. Euclid must sign a contract stating that they will not adopt or return the animal to the care or custody of Windy Johnston.  Violators of this agreement will be violating a court order and will be in jeopardy of being sued by the City of Indianapolis.
