Guardianships (With a Hearing & Without Signed Orders Appointing a Guardian)i.e., Adult Guardianships of Person and Estate, Contested Guardianships

  • Publication (check or money order only):
         Court & Commercial: $132.00, or
         Indianapolis Recorder: $109.00, or
         Indianapolis Star: $124.00

A filing for a guardianship with a hearing should include:

Note: The numbers in parentheses indicate how many copies of each document the Clerk will keep. In most cases this will be the original document. It is recommended that attorneys provide additional copies sufficient to their needs for processing by the clerk staff. 

  • Appearance (1)
  • Petition (1)
  • Physician’s Report (1), for Adult Guardianships
  • Clerk’s Certificate of Mailing*(1)
  • Notice of Guardianship Hearing (2)
    This notice must be sent via certified mail, served by the Sheriff (Clerk's Office requirements for certified mail), or by process service.  Also, two (2) notices and 1 copy of any enclosures (petition, order, etc) must be provided if you want the Clerk’s Office to serve the documents via Certified Mail, along with a Clerk’s Certificate of Mailing.  If you have any questions about the requirements, please call (317) 327-4718.

Guardianships (Without a Hearing & With Signed Orders Appointing a Guardian)i.e., Non-contested guardianship of person

  • Court's Instructions to Guardian of Person *(1), if applicable
  • Court's Instructions to Guardian of Estate *(1), if applicable

Temporary Guardianships only last for 60 days, and require the same type of documents as Regular Guardianships.
